Introduction:

The Great Desert Tracks Mapping Expedition began after Hema Maps identified an area in Australia that had not been mapped since the 1970s and certainly never with GPS technology and detailed, on-the-ground field checking. The area was so vast it had to be mapped in two phases. The first phase included every trafficable road and track from the Great Australian Bight in the south to the Kimberley in the north and from near the Stuart Highway in the east to the Pilbara in the west, which amounted to about 48,000km of tracks and roads travelled. The first phase culminated in the release of four maps in 1999. The second phase was field checked in 2000 and continued along the same northern and southern boundaries as the earlier map sheets and reached across to Quilpie in south-west Queensland and White Cliffs in Outback New South Wales. The field checkers clocked up 45,000km while surveying the 25,000km of additional roads and tracks for the two new sheets, as well as several thousand further kilometres in the area covered by the original four map sheets. The results of these expeditions are now two new and four revised maps.

Map Projection:
All of the Great Desert Tracks Maps are Lambert Conformal Conic Projections using the WGS84 datum. Contact Hema Maps for more information such as the standard parallels used.

Road Classifications:
The road and track classifications are based on a general assumption that map users are familiar with the often-rough condition of outback roads and tracks. Any unsealed road or track can be hazardous due to washouts, sand, mud or bull-dust patches and extreme corrugations. Use classifications as a general guide and always seek local advice.

GPS Plotted Roads and Tracks:
The PURPLE roads and tracks were accurately plotted with a GPS and laptop computer during the Great Desert Tracks Mapping Expeditions. Distances were also checked and have been rounded to the nearest kilometre (variations may occur due to wheel-slip and/or tyre pressure).

The RED road and track information has been compiled from AUSLIG 1:250,000 Geodata and other sources. The exact location and/or condition of these roads and tracks were not verified during the Expeditions so this information must therefore be treated with caution. (All highway information has been verified.)

Conditions on these maps are constantly changing. Help us keep them up to date by letting us know of any changes, errors or omissions. Hema Maps welcomes any GPS plot files of new road alignments or new tracks you may find, as well as comments or suggestions on how we can improve this product.

The "Great Desert Tracks" maps are displayed using the OziExplorer Lite map viewer. OziExplorer Lite is designed for map viewing but has other features available including Index Map Selection, Name Search, Area Calculation, the ability to add Map Features and Map Comments to a map, and Distance and Bearing Measurement. You can explore these features from the menu options or by using the button toolbar located under the menu for quick access to each feature.
Also available is the very popular OziExplorer GPS Mapping Software which will work with Garmin, Lowrance, Magellan, Eagle and MLR GPS receivers for the upload and download of waypoints, routes and tracks. With OziExplorer running on your computer and connected to a GPS, it can also be used for real time navigation (moving map) to show your position as you move.

The following is the Licence Agreement for Australia's Great Desert Tracks on CD-ROM. Please read this Agreement carefully before proceeding. This Agreement licenses the Product to you and contains warranty and liability disclaimers.

ATTENTION:
By clicking 'OK' or using the Product you are agreeing to be bound by the terms of the following Agreement. You may not use the Product unless you agree to these terms and conditions. If you do not agree to the terms of the Agreement, you must not use the Product and you may return the undamaged Product to the place of purchase for a full refund.

1. Licence Granted
1.1 The Agreement allows the Customer to:
(a) Use the Product on the Customer's Computer for non-commercial use either personally or within the Licensee's organisation only.
(b) Duplicate the Data contained in the Product on one computer only provided that the Customer reproduces on any such copy all copyright notices and readme files that are on the original Product. Any such copy is governed by the terms of the Agreement and is not permitted to be recopied.
(c) Print (in any manner) all Data and information contained in the Product.

2. Conditions of Use
2.1 Without written permission of Hema Maps Pty Ltd, the Customer agrees that it will not:
(a) Use the Product in a manner contrary to this Agreement.
(b) Digitise, vectorise or edit the Data other than permitted by this Agreement.
(c) Reproduce in any way, copy or extract any part of the Data and distribute it to a third party.
(d) Duplicate any data on the Product to another CD or CD-ROM or similar storage device.
(e) Remove, obscure or interfere with any copyright notice, trademark, warning or disclaimer contained in or on the Product or the Data.
(f) Commercialise the Data or derive any reward from the supply of the Data or any material printed or copied from the Data, whether modified or not.
(g) Transfer, give, assign, rent, lease, sell, charge, exchange, adapt (other than in the normal course of use), decompile, disassemble, create a derivative product or otherwise deal with the Product or the Data except pursuant to this Agreement.
(h) Use the Product in a manner contrary to any agreement the Customer has with any third party.

3. Ownership
3.1 Hema Maps Pty Ltd expressly reserves all copyright and any other intellectual property rights to the Product and only grants the customer a licence to use the Product as provided in this Agreement.
3.2 Hema Maps Pty Ltd retains ownership and intellectual property rights of and to the Data, whether in its original form or as modified, printed and/or copied by the Customer.
3.3 Hema Maps does not have any intellectual property or ownership rights to the OziExplorer Map Viewing Software.

4. Limited Warranties
4.1 Save to the extent permitted by law:
(a) The Product is provided to you "as is" without warranty of any kind, either express or implied. Hema Maps Pty Ltd does not warrant that the Product will meet your requirements or that the operations of the Product itself or in conjunction with other product will be uninterrupted or error free.
(b) The Customer is entirely responsible for determining the suitability of the Product for their purposes and the use they make of the Product.
(c) Hema Maps Pty Ltd disclaims all other warranties, either express or implied, including warranties of merchantability, fitness for purpose or for a particular purpose and non-infringement of third party rights unless such warranties are implied by law.
(d) Although a third party may provide technical support, Hema Maps Pty Ltd does not warrant that technical support will be provided for the Product.
(e) No oral or written information or advice given by Hema Maps Pty Ltd, its dealers, distributors, agents or employees shall create nor extend existing warranties. The Customer must not rely on any such information or advice unless in writing and signed by an authorised representative of Hema Maps Pty Ltd.

5. Limited Remedies
5.1 The liability of Hema Maps Pty Ltd for any breach of an express, statutory or implied warranty shall be limited, at its option, to the replacement and/or repair of the Product or a refund of the price paid by the Customer for the Product.

6. Limitation of liability
6.1 Whilst every effort has been made to ensure the accuracy of this product, Hema Maps Pty Ltd accepts no responsibility for any errors or omissions, which may be contained herein.
6.2 The Customer uses and relies on the Product entirely at their own risk and should not solely rely on the results or information obtained from the Product for any purpose, including navigation.
6.3 Hema Maps Pty Ltd shall not be liable for any loss or damage to person or property, loss of income, loss of revenue, trade, business, information or profits including any direct, indirect, incidental or consequential loss from the installation or use of the Product or reliance upon any Data (irrespective of whether or not the Data is used in any navigation system or for the purposes of navigation) whether based on breach of contract, tort (including negligence), product liability or otherwise.
6.4 Hema Maps Pty Ltd shall not be liable for any loss or damage caused as a result of the use of the OziExplorer Map Viewing Software however caused.
6.5 Hema Maps Pty Ltd shall not be liable for any information, advice or technical support given by a third party unless in writing and signed by an authorised representative of Hema Maps Pty Ltd.

7. Indemnity
7.1 The customer agrees to indemnify Hema Maps Pty Ltd for any loss or damage caused to the Customer or a third party as a result of any reliance made by the Customer on the Data or a breach by the Customer of any of the terms and conditions of this Agreement.

8. Choice of Law
8.1 This Agreement shall be governed by and interpreted in accordance with the laws of the State of Queensland. Hema Maps Pty Ltd and the Customer agree to be subject to the legal jurisdiction of the State of Queensland.
8.2 This Agreement contains the final, complete and exclusive agreement between Hema Maps Pty Ltd and the Customer and supersedes all prior or contemporaneous agreements, whether written or oral.

9. Termination
9.1 This agreement remains in force indefinitely unless the customer terminates the agreement by destroying the Product and any copies of the Data or the Customer breaches any term of this Agreement.
9.2 Upon termination the customer agrees to return the Product and any Data in material form to Hema Maps Pty Ltd, unless otherwise destroyed.

10. Inquiries
10.1 All questions concerning this Agreement can be directed to the Manager, Hema Maps Pty Ltd, 25 McKechnie Drive Eight Mile Plains Qld 4113.
10.2 It is always recommended that you obtain independent legal advice before entering into any binding agreement.

11. Definitions
(a) "Agreement" means the licence agreement between Hema Maps Pty Ltd and the Customer.
(b) "Product" means the Australia's Great Desert Tracks on CD-ROM and all the Data and Related Items supplied or contained therein excluding the OziExplorer Map Viewing Software.
(c) "Computer" means a single stand-alone computer not a server.
(d) "Customer" is the person or organization acquiring Australia's Great Desert Tracks on CD-ROM and is, accordingly, the licensee in respect of it.
(e) "D & L Software Pty Ltd" (ACN 096 504 951) is the developer of the OziExplorer Map Viewing Software and is the owner of the intellectual property rights therein.
(f) "Data" means the information and materials embodied in machine-readable media on the Product including, but not limited to, maps, artwork, illustrations, photographs, images and text.
(g) "Hema Maps Pty Ltd" (ACN 010 601 911) is the owner of the intellectual property rights, including copyright, and other rights in the Product and is the licensor of the Product.
(h) "OziExplorer Map Viewing Software" means the map viewing program and associated files developed and owned by D & L Software Pty Ltd.
(i) "Related Items" means the printed matter, artwork and packaging supplied with the Product and the concept and design of the Product.
