TERMS AND CONDITIONS

1. Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.

2. Claims are only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to claim.

3. Promotion commences on 28/07/2010 and closes at 5.00pm AEST on 30/09/2010 (“Promotional Period”). Final claims close at 5.00pm AEDST on 15/10/2010.

4. To be eligible to claim, individuals must, during the Promotional Period, purchase any Garmin nuvi or zumo product (excluding nuvi 255 and nuvi 465T) from any authorised Garmin retailer. Purchases made through any online bidding or auction websites are not permitted.

5. To claim, individuals must then visit www.garmin.com.au, follow the prompts to the competition entry page, input the requested details, attach a scanned copy of their purchase receipt(s) and barcode(s) or upload a photograph of their purchase receipt(s) and barcode(s) and submit the fully completed online entry form by 5.00pm AEDST on 15/10/2010. Claims received after this date will be deemed invalid and ineligible. In the case that an individual cannot provide an electronic copy (either scanned or photographed) of their purchase receipt(s) and barcode(s), they can submit their fully completed online entry form without attaching their proof of purchase. They will then be sent an email from the Promoter containing their completed entry form. Individuals must then print the completed entry form, attach a photocopy of their purchase receipt(s) and barcode(s) and send together to Garmin Australasia Pty Ltd, Attn: Promotions, PO Box 684, Seven Hills NSW 1730 so that it is received by 5.00pm AEDST on 15/10/2010.

6. The Promoter reserves the right, at any time, to verify the validity of entries and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Incomplete, indecipherable or illegible claims will be deemed invalid.

8. Multiple claims permitted, subject to the following:
(a) only one (1) claim permitted per specified purchase requirement;
(b) each claim must be submitted separately and in accordance with claim requirements; and
(c) a maximum of three (3) claims per person is permitted.

9. Claimants must retain their original purchase receipt(s) and their original product barcode(s) for all claims as proof of purchase. Failure to produce the proof of purchase for all claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s claims and forfeiture of any right to a gift.

10. Successful claimants will be notified by email. The Promoter’s decision is final and no correspondence will be entered into.

11. Every valid claim received will each be awarded with the gift of a Garmin Lifetime Map Update (part number 010-11387-00) valued at $189. Gifts will be awarded in the form of a code which will be sent to the entrant’s nominated email address. The Garmin Lifetime Map Updates are large files and may take time to download. Therefore it is not recommended for use with dial-up Internet access or satellite Internet providers. Please allow up to 8 weeks to receive your Lifetime Map Update code via email.

12. If any gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with an offer to the equal value and/or specification, subject to any written directions from a regulatory authority.

13. Gifts are not transferable or exchangeable and cannot be taken as cash.

14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

15. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that entrant invalid.

16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in offer value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a claimant; or
(f) use of a gift.

17. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
